Enhancing Broomfield’s Oil and Gas Regulations

Project Summary

The passage of Senate Bill 181 in April 2019 granted additional authorities to municipalities to enhance regulations around oil and gas development in their communities. In response, Broomfield drafted a city ordinance to further protect public health, safety, and welfare in the city and county. 

In order to gather input from the public on the proposed changes to oil and gas regulations, staff held three community workshops. Comments received from residents at these workshops were considered when finalizing the draft regulations. 

On May 12, 2020, Ordinance No. 2123 was adopted, revising zoning requirements described in Chapter 17-54 of the Broomfield Municipal Code by limiting oil and gas development to specific zone districts, prohibiting such development on parks and open lands, and establishing a 2000 foot setback for future oil and gas development.

In response, Broomfield is currently drafting a city ordinance to further protect public health, safety and welfare in the city and county. Your feedback on the proposed revisions to Broomfield’s oil and gas regulations is critical at Community Workshops as listed below in seven general themes.

October 15, 2020 - An updated redline of the draft regulations is available here.

The updated regulations were discussed at the October 20, 2020, Study Session. (View the Study Session memo here.) Due to the ongoing rulemaking hearings at the Colorado Oil and Gas Conservation Commission, City Council requested a delay in the adoption of the updated regulations. First reading of an extension of the current oil and gas moratorium will be presented at the October 27, 2020, Council Meeting. If approved on second reading in November, the moratorium will be extended through June 4, 2021. The Oil and Gas regulations will then be presented in early 2021.
