The applicant is seeking approval of a revocable permit to allow for a sidewalk or portion of sidewalk associated with the Brownstone North residential development to be installed/constructed within Tract A of Palisade Park Filing No. 4, Replat D. This tract is owned and maintained by the City and County of Broomfield and is intended to be used as a park. In addition to the sidewalk, the applicant is also seeking approval to allow for two area drain connections and a private storm connection to encroach into Tract A.

City and County Staff Analysis

Public Land Dedication: The property was previously dedicated as Public Land Dedication as part of the approval of the site development plan for the project. The intention was for Tract A to be developed as a park which would be owned and maintained by the City and County of Broomfield. The applicant's requested revocable permit would mean a portion of Tract A would be used for non park purposes. As part of the revocable permit process, Broomfield may require the applicant to provide a cash-in-lieu payment for the use of the portion of publicly owned land. The cash-in-lieu rate is $86,000 per acre, should the area required to accomodate the elements in the revocable permit be less than an acre then the cash-in-lieu total would be appropriately prorated.
