Project Description: Cole Valley Partners has submitted a site development plan for Broomfield's City Council consideration. The project is located in unincorporated Jefferson County but has an existing utility agreement in place for Broomfield to provide water and sewer services to the property. The agreement outlines that Jefferson County is the governing authority for the development of the property including zoning, platting, site development plan and other land use actions. The land use entitlements shall utilize Jefferson County's approval process. The site plan will be reviewed by and approved by Broomfield's City Council as per the agreement.

Conformance with the Zoning and Compatibility with Surrounding Uses: The property is located within unincorporated Jefferson County (JeffCo) and will be required to conform with JeffCo's zoning, comprehensive plan, and development standards. Broomfield will not review these elements for compliance, that conformance check will be done by review staff with JeffCo.

Utility Service Agreement Summary: As previously noted there is an existing utility service agreement in place for this property. This agreement outlines that the developer will be responsible for paying all costs of license and tap fees, inclusions and construction necessary for the provision of water and sewer service to the property. This includes monthly consumption charges which are equal to the monthly consumption charges paid by Broomfield users. Additionally, the agreement requires the property owner to pay a cash-in-lieu of property tax payments to be paid with the schedule for real property taxes set forth in applicable Colorado state statute, monthly sales taxes, and use tax(es) for any building materials incorporated into the improvements of the property.

Potential Key Issues for Discussion: At this time staff has not identified any key issues or major comments with this development proposal.
